List of Inside Information and Transparency Platforms

Market participants shall publicly disclose inside information which they possess with regard to the businesses or facilities that they or their parent undertaking or a related undertaking own or control, or whose operational matters they or their undertaking are responsible for, either fully or in partially.

In general, inside information should be disclosed in such a manner ensuring that it is capable of being disseminated to as wide a public as possible. This is why the disclosure of inside information through central platforms that aggregate urgent market messages from market participants is considered effective.

In 2020, the Agency commenced the process of registering Inside Information Platforms (IIPs) as Regulated Information Services (RISs) based on their compliance with the minimum quality requirements for effective disclosure of inside information, as defined in the ACER Guidance. The table below provides information on the applications received by the Agency and the status of their evaluation.

The ultimate goal is to provide a list of IIPs that comply with the requirements and can therefore be used for the effective disclosure of inside information.

The registration of IIPs takes place in two phases. During the first phase, the Agency assesses both the applications submitted by IIPs and the IIPs’ websites for the disclosure of inside information, in order to verify compliance with the following seven requirements: (1) public disclosure on a non-discriminatory basis and public accessibility free of charge, (2) public disclosure by means of web feeds, (3) record keeping and availability for public, (4) language of publication, (5) minimal availability, (6) administrative arrangements to prevent conflicts of interest with market participants, and (7) reporting of inside information in line with the Manual of Procedures on data reporting.

During the second phase, the Agency assesses the collection of inside information via web feeds, namely the reliability of the web feed(s) and the disclosure of inside information on the IIP website vs. via the web feed, according to the Manual of Procedures on data reporting.

According to Article 4(4) of REMIT, the publication of inside information, including in aggregated form, in accordance with Regulation (EC) No 714/2009 or (EC) No 715/2009, or guidelines and network codes adopted pursuant to those Regulations, constitutes simultaneous, complete and effective public disclosure.
